1. About these terms

These terms apply to the Wax & Wine website waxandwine.co.za, the Wax & Wine web app and any related services ("Wax & Wine"), operated by Premium Delivery Bike Rentals (registration number 2025/694758/07), of [PLACEHOLDER: physical address] ("we", "us"). Wax & Wine is a trading name of Premium Delivery Bike Rentals. By using Wax & Wine you agree to these terms and our Privacy Policy. Section 13 contains terms that limit our liability; please read it carefully (CPA section 49).

2. Who can use Wax & Wine: 18+ only

• You must be 18 or older. Wax & Wine is not for anyone under 18, and we do not market to minors.
• You must give a true date of birth. We may ask for proof of age and suspend accounts we reasonably believe belong to someone under 18.
• Farms may ask for ID before serving alcohol. Not having a Wax & Wine account never entitles anyone to be served.

3. What Wax & Wine is (and isn't)

• Wax & Wine is a cellar-door membership: you collect a seal at each participating farm by checking in on your phone within 500m of the estate. You also earn points and tiers, take quizzes, plan routes, see farm deals and events, and post Route notes.
• We do not sell, supply or serve alcohol. Each farm ("partner estate") is solely responsible for its own tastings, sales, prices, licences, opening hours, age checks, deals, events and the services it provides. Any purchase is between you and the farm.
• Farm details, deals and events are supplied by farms. We approve them before they appear but cannot guarantee they are accurate or available. Check with the farm before you travel.
• Featured placements are paid for by farms and are labelled "Featured".

4. Responsible drinking

• Wax & Wine celebrates wine culture, not quantity. We align with the Alcohol Industry Communications Code of Conduct of the Drinks Federation of South Africa (DF-SA) and Aware.org (the Association for Alcohol Responsibility and Education, formerly ARA), and with the Liquor Act 59 of 2003.
• Nothing in Wax & Wine rewards drinking more. Points are for visits, notes, quizzes and tastings, not for how much you drink; daily and per-visit limits apply.
• Use the spittoon, eat, drink water, and know your limits. Farms may refuse service to anyone who appears intoxicated.
• Don't drink and drive. On route-planner days, choose a designated driver, book a tour or shuttle, or use a ride service. The legal blood-alcohol limit for most drivers in South Africa is 0.05 g/100 ml (0.02 g/100 ml for professional drivers) [PLACEHOLDER: attorney to confirm current limits].
• Do not use Wax & Wine if you are pregnant and drinking, or if alcohol would be unsafe for you.
• Not for persons under the age of 18. Drink responsibly.

5. Your account

• Keep your sign-in details private; you are responsible for activity on your account. One account per person.
• Tell us at hello@waxandwine.co.za if you think your account has been misused.

6. Seals, points, tiers and rewards

• Seals, points and tiers have no cash value, cannot be sold, transferred or exchanged for money, and are not legal tender or a stored-value product.
• Current earning rules: visit (base points, when you check in within 500m of the estate); Route note (10 points, once per estate per day); weekly quiz (5 points, once a week); blind tasting (10 points, once per visit). Plus doubles base visit points only. Tiers: Explorer, Enthusiast (200), Connoisseur (800), Ambassador (2 000).
• We may change earning rules, tiers and rewards with reasonable notice. Points already earned won't be removed except for errors, fraud or breach of these terms.
• Faking a check-in, or other abuse, may lead to points being removed and the account suspended.

• If Wax & Wine closes, points and seals end. We will give at least [PLACEHOLDER: e.g. 30] days' notice.

7. Wax & Wine Plus

• Plus is an optional yearly subscription costing [PLACEHOLDER: price] per year (VAT [PLACEHOLDER: included / not applicable]). Benefits are listed on our Membership page and may change; we will not materially reduce them during a paid year.
• Billing: paid upfront through [PLACEHOLDER: payment provider]. Plus renews automatically each year unless you cancel. We will remind you at least [PLACEHOLDER: e.g. 20 business days] before renewal, in line with CPA section 14.
• Cooling-off (ECTA section 44): if you subscribed online you may cancel within 7 days of subscribing for a full refund, without reason or penalty. If you have already used Plus-only benefits (for example redeemed a member-only deal), [PLACEHOLDER: attorney to confirm treatment].
• Cancelling later: you can cancel at any time in Settings or by emailing hello@waxandwine.co.za. Plus stays active until the end of the paid year. [PLACEHOLDER: attorney to confirm whether CPA section 14 pro-rata refund / reasonable cancellation penalty applies to a fixed-term yearly plan.]
• Price changes apply only from your next renewal, with notice.

8. Route notes (user content)

Route notes is a members-only page for honest reviews and photos, not a social network. When you post:

• Be honest, fair and about your own visit. No fake reviews, and no posts paid for by a farm unless disclosed.
• No photos of anyone under 18, and only of people who agreed to be shown.
• No content that glamorises excessive drinking, drinking and driving, or drinking by minors, or that links alcohol to social, sexual or sporting success (DF-SA and Aware.org code).
• No hate speech, harassment, threats, defamation, personal information about others, spam, or content you don't have the rights to.
• You keep ownership of your content and give us a non-exclusive, royalty-free licence to show it in Wax & Wine and, with the farm it concerns, in that farm's portal. If we want to use it in marketing outside the app, we will ask first.
• We and the farm concerned may hide or remove content that breaks these rules. Report content to hello@waxandwine.co.za.

9. Farms

Farms that join Wax & Wine agree to separate partner terms [PLACEHOLDER: link], including their responsibility for liquor licensing, age verification, accurate deals and the protection of visitor information.

10. Suspension and closing your account

• You can close your account at any time in Settings.
• We may suspend or close an account, after warning where reasonable, for under-age use, fraud, abuse of staff or farms, breach of section 8, or breach of these terms. Points on a closed account lapse. Where we close a Plus account without cause, we refund the unused portion.

11. Intellectual property

The Wax & Wine name, seals, designs and software belong to us or our licensors (farm artwork used in seals belongs to the farm). You may not copy or reuse them without permission.

12. Availability

Wax & Wine is provided as available. We aim to keep it running but there may be interruptions, especially during the pilot. Features may change.

13. Liability

• To the extent the law allows, we are not liable for: the acts, products, services, prices or premises of farms; accidents, injury or loss arising from alcohol consumption or travel between farms; indirect or consequential loss; or loss caused by events outside our reasonable control.
• Our total liability to you is limited to the amount you paid us in the 12 months before the claim (or R[PLACEHOLDER] if you paid nothing).
• Nothing here limits rights you have under the Consumer Protection Act that cannot be excluded, or liability for our gross negligence or wilful misconduct.

14. Electronic communications (ECTA)

15. Changes

16. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. Please contact us first at hello@waxandwine.co.za; we'll try to resolve any complaint within [PLACEHOLDER] business days. You may also approach the Consumer Goods and Services Ombud or the National Consumer Commission. Disputes may be heard by a competent South African court, including the magistrates' court with jurisdiction.
